Three Floyd county deputies that were dismissed in October for county and departmental violations have had their appeal rejected by the Floyd County Personnel Board.
After a Doraville police officer stopped Jason Duke, Randy Minter, and Gene King for speeding while they were off duty September 16, the three deputies were accused of swearing out a false complaint against the officer.
Due to their lack of credibility, Floyd County Sheriff, Tim Burkhalter said the three men had to be dismissed.
At Tuesday’s hearing where the deputies were represented by Sanford “Buddy” Hill of Summerville, Doraville Police Chief John King, the traffic officer, and a representative from the sheriff’s office all testified.
The three men could face felony charges for false swearing since the complaint came with sworn affidavits.
Floyd County District Attorney, Leigh Patterson will make a decision on the findings turned over to her by the GBI.
Sheriff Burkhalter said the men continually insisted that King used profanity in the presence of children in the car even after he gave them a chance to be truthful about the situation in order to save their jobs.
The GBI reviewed a DVD recording which supported the Doraville officer’s version of the incident.
