Entice Receives Response from Floyd County

Contrary to Entice Adult Superstore’s assertion in their request for a preliminary injunction, evidence has been presented to show the adult superstore is within 1000 feet of developed property.

Exhibits and affidavits were filed by Floyd County in response to a preliminary injunction requested by Entice Adult Superstore in U.S. District Court last month.

In order to stop the county from enacting an ordinance that would force the business to close, Entice filed for a preliminary injunction.

By statute, a business such as Entice, can not be located within 1000 feet of residential zoned property or the sale of alcohol.

Marshall Plants, Geographic Information System Manager for Rome and Floyd County presented evidence that showed Entice’s location is within 1000 feet of residential zoned property and a residence.

Entice’s injunction request states that even though it’s within 1000 feet, the landed zoned residential is undeveloped.

According to Plants, the residence in question is 385 feet from the adult superstore.

Plant’s evidence shows a number of sites that the county says could legally be occupied by a sexually oriented business.
